Terms of Service

Sway ("we", "us", "our") operates a multi-vendor online marketplace that connects independent sellers ("vendors") with buyers. By accessing or using sway.com or related services, you agree to these Terms of Service.

Sway is developed by AKTUM. We provide the platform, payment processing integration, and support tools; vendors are responsible for their listings, pricing, and fulfilment unless otherwise stated.

You must be at least 18 years old and able to enter a binding contract to use Sway.

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate registration information and update it when it changes.

Sway is a marketplace, not the seller of record for vendor-listed products. When you purchase from a vendor, you enter into a contract with that vendor for the product; Sway facilitates the transaction, payment, and dispute process.

Product descriptions, images, and availability are provided by vendors. We may remove listings or suspend accounts that violate our policies or applicable law.

Prices are shown in Ghana Cedis (GHS) unless stated otherwise. Checkout may include items from multiple vendors in a single order; each vendor fulfils their portion separately.

Payments are processed securely through Paystack. You may also pay from your Sway wallet balance where available. Pre-order items may require a deposit at checkout with the balance due on delivery, as shown before you pay.

An order is confirmed once payment is successfully received or your wallet is debited. We may cancel unpaid or fraudulent orders.

Vendors must provide accurate listings, honour orders they accept, comply with applicable laws, and maintain appropriate business licences where required. Vendors are responsible for taxes on their sales unless Sway is legally required to collect or remit them.

Sway may charge commissions and fees as disclosed in the vendor dashboard or separate vendor agreements.

You may not use Sway to:

• Sell or buy illegal, counterfeit, or restricted goods
• Misrepresent products, prices, or your identity
• Interfere with platform security or other users' accounts
• Abuse reviews, coupons, referrals, or dispute processes
• Scrape, reverse engineer, or overload our systems without permission

Sway's brand, software, and site content are owned by us or our licensors. Vendors retain rights to their own product content but grant Sway a licence to display and promote listings on the platform.

Sway is provided "as is" to the fullest extent permitted by law. We do not guarantee uninterrupted service or that every transaction will be error-free.

To the extent allowed by law, Sway and AKTUM are not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim related to a transaction is limited to the fees Sway earned on that transaction or GHS 500, whichever is greater, except where liability cannot be limited by law.

We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.

We may suspend or terminate accounts that breach these terms. You may close your account at any time through your profile settings, subject to completing outstanding orders and obligations.

These terms are governed by the laws of Ghana, without regard to conflict-of-law principles.
